Welcome to Groovetown (the “Service”). By accessing or using our website, web application, or player features, you agree to be bound by these Terms of Service.

1. Scope of Service & Audio Content Disclaimer

  • Directory Indexing: The Service acts as a search index and user interface for public internet radio streams retrieved dynamically via the community-driven Radio-Browser API.
  • No Hosting or Content Ownership: The Service does not host, upload, re-transmit, record, or store any audio streams, music, broadcasts, or media content. All intellectual property rights, trademarks, and copyrights associated with third-party audio streams belong strictly to their respective owners and broadcasters.
  • Availability: We do not guarantee the uptime, audio quality, legality, or uninterrupted availability of any third-party stream indexed through the Radio-Browser database.

2. Free vs. PRO Player Membership

  • Free Access: The standard web player is supported by third-party advertising and provides search and playback capabilities.
  • PRO Features: Upgrading to the PRO version grants access to interface enhancements, including saved favorites, custom audio processing tools (such as the 12-band graphic equalizer and bass boost), and real-time audio visualization tools.

Clarification of Fees: Subscription or lifetime fees paid to the Service are solely for licensing software tools, custom user interface customization, and audio processing tools. Payments do NOT purchase access to, rights in, or commercial licenses for any audio streams or underlying copyrighted content.

3. Subscriptions & Payments

  • Billing: All payment transactions are processed securely through third-party payment providers. You agree to provide accurate billing details.
  • Refunds: Payments for digital enhancements and PRO features are subject to our standard refund policy upon account activation.

4. Acceptable Use & Limitation of Liability

Limitation of Liability: To the maximum extent permitted by the laws of Canada and applicable provincial jurisdiction, Groovetown shall not be liable for any direct, indirect, incidental, or consequential damages resulting from third-party stream unavailability, content copyright disputes, or service interruption.

Acceptable Use: You agree not to intercept, scrape, reverse-engineer, or commercially exploit the player infrastructure or API queries.

Refund & Cancellation Policy

1. Subscription Cancellation

You may cancel your Groovetown PRO subscription at any time through your account dashboard.

  • Access Period: Upon cancellation, your PRO features (including saved favorites, 12-band equalizer, and spectrum analyzer) will remain fully active until the end of your current paid billing cycle.
  • Non-Renewal: Cancelling prevents any future automatic charges to your payment method.

2. Refund Policy

  • No Pro-Rated Refunds: Except where required by law, payments for PRO subscriptions are non-refundable. We do not provide cash refunds, partial refunds, or account credits for unused days or remaining time within a billing cycle once a charge has processed.
  • Technical Issues: If you experience a continuous technical defect with software features that our support team cannot resolve within a reasonable timeframe, you may contact [email protected] to request a manual review of your account for a discretionary refund.

Copyright & Stream Removal Notice

1. Intellectual Property & Indexing Statement Groovetown is an index and user directory. We do not host, store, stream, or re-transmit any media files or live broadcasts on our servers. All stream URLs, station metadata, and audio content are sourced dynamically from the open, community-driven Radio-Browser API. Rights to all audio content belong strictly to the respective station owners, broadcasters, or copyright holders.

2. Notice and Takedown Procedure If you are a radio station owner, broadcaster, or authorized copyright representative and believe that a link indexed by our Service infringes upon your rights or you wish to have your station removed from our search results, please send a written notification containing the following details:

  • Contact Information: Your full name, organization/station name, email address, and physical address.
  • Station Details: The exact name of the station as it appears on our platform and, if applicable, the stream URL.
  • Proof of Authority: A statement indicating that you are the copyright owner or authorized to act on behalf of the owner of the broadcast rights.
  • Statement of Good Faith: A declaration that you believe in good faith that the use/indexing of the stream link is not authorized by the copyright owner, its agent, or the law.

3. Submission & Action

  • Direct Removal via Upstream Database: Because our directory fetches station links directly from the community database at Radio-Browser.info, removing or updating your listing at the source will automatically update or remove it from our Service.
  • Direct Takedown Requests: You may also submit takedown notices directly to us at [email protected]. Upon receiving a complete notice, we will make reasonable efforts to blackball or remove the specific station stream link from displaying in our search directory within 3 business days.
